Q: I’m employed through a temp agency and I was hurt at work. Can I still file for workers' compensation?
A: In Ohio, if you were hurt at work and you are a regular W2 employee, you should be able to successfully pursue a workers' compensation claim. Though the structure may vary from agency to agency, most temporary staffing companies have their employees categorized as W2 employees. It is often difficult, for instance, to receive benefits for your time off, since most temporary assignments are for such short periods of time. Likewise, there could be a dispute between the agency and the place you were assigned as to whose workers' compensation policy should step in and pay your bills.
